Parking

By entering this Car Park (subject to clause 1 below), you, as a patron using this Car Park accept that a contract is formed between you and us, Council on the terms and conditions ("Terms") (and no other) as set out below.

1. If you do not accept these Terms you and the vehicle in which you entered with ("Vehicle") must immediately leave the Car Park. If your Vehicle leaves immediately from entering, you will not be charged a parking fee.
2. You must comply with all rules and directions displayed within the Car Park and any directions given to you by our staff at all times. Failure to do so may require you and the Vehicle to leave the Carpark immediately. Any applicable parking fees are due and payable.
3. You agree that you enter and/or use the Car Park at your own risk.
4. You must exercise your best endeavours in good faith with due care for a proper purpose as far as is practical in using the Car Park in any way and whilst remaining in the Car Park at all times.
5. You may only park in an area marked "Reserved" if that area is reserved for the Vehicle with a valid licence or you are otherwise authorised by us to park in that area. You acknowledge and agree that penalties apply to Vehicles parked in the area marked “Reserved” without a valid licence.
6. You may only park in an area marked “Electric Vehicle only” if your Vehicle is an electric vehicle. You acknowledge and agree that penalties may apply to Vehicles parked in the area marked “Electric Vehicle only” if your Vehicle is not an electric vehicle.
7. We warrant that any services provided by us be rendered with reasonable care and skill. We make no other express warranties in relation to the services we provide. All other warranties, representations and conditions relating to the services (whether express or implied and whether arising in contract, at common law or under statute) are to the maximum extent permitted by law expressly excluded.
8. You acknowledge that we are not liable to you (or any driver or passengers in the Vehicle, or any party) for any loss, cost or damage whatsoever arising out of or in connection with your entry and use of the Car Park in any way.
9. You acknowledge that we are not liable to you (or any driver or passengers in the Vehicle, or any other party) for any loss, damage, injury or any incidental, indirect, special, consequential or economic loss or damage (including loss of opportunity, exemplary or punitive damages) whether to person, animal or property including the Vehicle and whether arising from any default, negligence, misconduct or otherwise arising from actions performed by us, our employees and/or agents.
10. You agree to pay the parking fees applicable for the duration of time between when the Vehicle enters and exits the Car Park in accordance with Council’s Pricing Policy, Fees and Charges and as displayed within the Car Park. You must pay us all parking fees applicable and other costs which we may incur in relation to the Vehicle upon demand. A further parking fee is payable each time the Vehicle enters the Car Park. Early Bird rate applies in accordance with Council’s Pricing Policy, Fees and Charges and as displayed within the Car Park. Any extended parking beyond these hours will incur full parking fees calculated from the actual time of entry to the time of exit in accordance with Council’s Pricing Policy, Fees and Charges and as displayed within the Car Park notwithstanding the time period when the Early Bird rate applies. Night Owl rate only applies in accordance with Council’s Pricing Policy, Fees and Charges and as displayed within the Car Park. Any extended parking beyond these hours will incur full parking fees calculated from the actual time of entry to the time of exit at the parking rates in accordance with Council’s Pricing Policy, Fees and Charges and as displayed within the Car Park, notwithstanding the time period when the Night Owl Rate applies. If you lose or fail to present the required parking entry ticket or the designated mean(s) of entering and accessing the Car Park, you will be charged the maximum daily rate amount. All parking fees must be made in full prior to the Vehicle leaving the Car Park.
11. We reserve the right to retain possession of the Vehicle until all parking fees and other costs incurred by us in respect of the Vehicle have been paid in full. Parking fees will continue to accrue until you have paid all fees in full and have complied with all the terms and conditions applicable to the use of the Car Park.
12. In the event that the Vehicle is retained by us and the outstanding parking fees and any other costs which we may incur in respect of the Vehicle remains unpaid after 30 days after it was due and payable, you hereby irrevocably agree that we can sell the Vehicle and you agree to take all steps required by us to enable us to do so. You also irrevocably agree that the proceeds of the sale will be used to cover the outstanding parking fees and costs including the costs associated with the sale of the Vehicle including legal costs.
13. You are liable for any damage caused by you or the Vehicle to the Car Park, including but not limited to; any property in the Car Park including ticket machines, boom gates, signs and any damage caused by oil or other substances which leak from the Vehicle.
14. You agree to indemnify us and continue to keep us indemnified against all losses which we may suffer arising from or in any way relating to: (a) a breach of these Terms by you; (b) the Vehicle; or (c) the use of the Car Park by you, the driver and/or passengers of the Vehicle or any other person acting as your agent or with your authority or is otherwise under your responsibility.
15. You must comply with all applicable laws and requirements arising out of or in connection with your entry of this Car Park with or without a Vehicle, including and without limitation to any of your obligations under an existing lease or licence that you may have in connection with the Car Park. Note: No warranty as to the security of this car park is expressed or is to be implied by the use of the word "Fairfield City Council" in our logo or trading name.
